Heritage advice, negotiations and preparation of planning and listed building consent applications to avert threatened enforcement action and prosecution for alleged unauthorised works to a Grade II listed building.

 

In her previous role, founding director Joanna Burton was approached by planning solicitors to assist their client in resolving the threat of prosecution and enforcement against alleged unauthorised works undertaken to a Grade II listed property. By undertaking a thorough review of the planning history and works undertaken together with an appraisal of the significance of the building, Joanna was able to agree with planning officers that some of the alleged works already had the benefit of consent, others were non-controversial and could be regularised through a retrospective application, and limited remedial works to make acceptable those works needing to be rectified. The planning authority agreed not to pursue the prosecution of the owners and enforcement proceedings were avoided.
